MPs attack private security guard immigration removals

Mr Mubenga was being escorted by
staff from the private security firm G4S
Private security guards employed to forcibly remove people from the UK have used racist language and inappropriate force, a report by MPs has said.
The Commons' Home Affairs Committee said the UK Border Agency should challenge unacceptable behaviour by some of its contractors.

The report comes 15 months after a deportee died on a flight.

A spokesman for the UKBA said that all private security escorts are trained in approved restraint techniques.

Jimmy Mubenga, 46, fell ill and collapsed on a British Airways plane bound for Angola on 12 October 2010.

The MPs did not comment on the case, which is still being investigated by the police, but said that Mr Mubenga's death had triggered their own investigations into the way that the UK Border Agency managed the deportation of people on flights from the UK.

The UKBA contracts out the job of escorting people to their deportation flight. The contract has been held by Reliance since May 2011 and previously by G4S.

The MPs said found:

Inappropriate use of physical restraint, including some techniques that could be dangerous

Some contractors using racist language

Excessive numbers of security guards for some deportations

"It is a matter for serious concern that contractors should use racist language among themselves," said the report.

"That they were content to do so in front of not only UK Border Agency staff but also inspectors from HM Inspectorate of Prisons is shocking. It is possibly the result of a relationship between the Agency and its contractors which had become too cosy."

Restraint techniques
The MPs said that the UKBA's own staff should feel that they can properly challenge any bad behaviour by contractors - but it also criticised the practice of taking "reserves" to airports - people who may then find that they are not being removed from the UK after all.

It called on the government to allow independent monitors, people allowed into prisons and removal centres, to board removal flights.
Restrained: A volunteer in a scientific test suffered
breathing problems during tests

The MPs said that they were not convinced that a potentially harmful head-down restraint position was never used, even though it was not authorised.

A recent expert report found that such techniques could lead to death.

"We recommend that the Home Office issue urgent guidance to all staff involved in enforced removals about the danger of seated restraint techniques in which the subject is bent forwards.

"We also recommend that the Home Office commission research into control and restraint techniques which are suitable for use on an aircraft. The use by contractors of unauthorised restraint techniques, sanctioning their use, or failing to challenge their use, should be grounds for dismissal."

Keith Vaz MP, chairman of the committee, said: "The UK Border Agency must not wash its hands of responsibility for detainees just because the service is contracted out.

"People who are not entitled to remain in the country must be removed and there may be occasions when it is necessary to use physical force, but this must always be done only when absolutely necessary, and with proper respect for the dignity of the detainee."

A UKBA spokesman said: "All escorts on flights are trained to use restraint techniques approved by the Prison Service.

"We have no evidence contractors use head-down restraints and would take strong action against them if their conduct does not meet our standards.

"We are currently working closely with Noms (National Offender Management Service) to develop specific techniques appropriate to confined spaces."

Security guard trapped in "sweltering" van in Truro

A security guard had to be rescued by firefighters after he became stuck in the back of his van on Lemon Quay in Truro.
Passers-by heard the trapped man's call for help from within a secure G4S van.

They immediately called the fire brigade in an attempt to rescue him.

He had become stuck in a small, secure compartment inside the van, which is normally used to safely transport large sums of cash.

Truro fire station's watch manager Jason Boeuf said the middle-aged man was trapped for 45 minutes. He said: "With the van being so secure, we had to use tools to cut away the hinges of the door to release him.

"It was sweltering inside.
"It was a small space and although he was hot and bothered, no harm was done."

Britain's kindest security guard

Gareth Gore went above and beyond the call of duty
Gareth Gore works in Bolton's Marks and Spencer, and went well above and beyond the call of duty to help a man suffering from dementia locate his wife who had been taken to hospital
A worker who came to the aid of a lost pensioner has been hailed Britain’s kindest security guard.

Gareth Gore went out of his way to help the stranger after seeing him lost and alone in Bolton town centre.

Big-hearted Gareth, a security guard at the town’s Marks & Spencer, spotted the distressed elderly gentleman wandering outside the store.

The man, who suffers from dementia, had become separated from his wife after she had a serious fall during a shopping trip.

After unsuccessfully scouring the streets to find the man’s wife, Gareth dialled for police and helped locate the injured woman, who had been rushed to Bolton Royal Infirmary.

But the security man went beyond the call of duty and – his shift having finished – took it upon himself to drive the husband to the hospital.

He then waited an additional hour until the woman had been released so that he could take them both back to their car, located in the town centre, where he gave them directions to the motorway and saw them safely on their way.

Gareth, who is employed by security firm Securitas, has been stationed at the Marks and Spencer’s branch for six years.

Gareth Gore (left) with Trevor Elliott from the British
Security Industry Association
And his exemplary behaviour has seen him nominated for the British Security Industry Association’s ‘outstanding act’ award.

Chloe McGuirk, a senior manager at Securitas, said: “We are proud to have Gareth as one of our security officers.

“It takes a very genuine and compassionate person to go out of their way to assist in the way he did.

“I am sure this couple and their family, along with Securitas, will never forget what he did.”

Gareth said: “I am surprised, yet thrilled that my instinct to help has led to such an accolade.

“I am just happy that I was there on the day to be able to give assistance.”

Guard walks home naked after employer grabs uniform

A 53-YEAR-OLD security guard of Mazabuka district was last week forced to walk home naked after his employer dismissed and forced him to hand over the company uniform after he allegedly deserted his workplace.

He has since, however, been reinstated.

Likwasi Chimonde, a resident of Kabbobola compound last week walked in his pants from Kaleya to his home, a distance of about three kilometres, after CHC Commodities project manager Baker Russell ordered him to undress and hand in his uniform on allegations that he failed to provide security at the workplace.

Mazabuka district senior labour officer Charles Muwowo confirmed that his office received a complaint of unfair dismissal and inhuman treatment from Chimonde, who was employed as a watchman by CHC Commodities, a grain storage company located within Mazabuka township.

Muwowo said he decided to summon Russell to his office after Chimonde lodged a complaint that he was dismissed instantly and forced to walk home naked after he decided to lock the gate and leave the premises in order to buy some painkillers upon developing a headache.

He disclosed that Chimonde was ordered to surrender the company uniform by Russell who went to the company premises around 20:00 hours and discovered that Chimonde was not present on site.

"This watchman claims he was not feeling well when he reported for duty around 18:00 hours and that around 19:00 hours he decided to go to nearby shops to buy some painkillers and it was that time that his project manager (Russell) visited the site and discovered that the guard was absent and the place unmanned," narrated Muwowo.

Muwowo further disclosed that when Chimonde returned to his place of duty, he found Russell, who was inside the premises after jumping over the gate and immediately demanded the company uniform from him before ordering him to go back home.

He said during his discussions with the two men, Russell, who admitted ordering Chimode to take off the uniform, apologised over his action and promised to reinstate him immediate.

Muwowo said Russell, in his defence, said he reacted in such a manner because Chimonde put the company property at risk, which he said was worth millions of kwacha and that if Chimonde was unwell as he claimed, he should have simply phoned him so that he could be excused from work.

He described the incident as a serious violation of human rights, warning that his office would not hesitate to bring to book employers who deliberately violate the Zambian labour laws.

Muwowo cautioned employees to ensure they follow regulations of the entities they work for in order to avoid getting into conflict with their employers.

Meanwhile, Muwowo revealed that the labour office in the district has this year handled a total of 127 labour complaints and recovered a total of K136, 000 on behalf of various deserving employees who reported their complaints to the office.

He told the district development and coordinating committee meeting that despite facing numerous operational challenges, his office remained committed to ensuring that labour laws are strictly followed and adhered to by both employers and employees.

Shard climb protest: Greenpeace activists bailed

Six Greenpeace activists who were arrested after climbing to the top of London's Shard have been bailed.

The six women were arrested on suspicion of aggravated trespass after their 16-hour ascent on Thursday in protest against Arctic oil drilling.

At the skyscraper's summit two of them unfurled a blue flag with Save the Arctic written on it. The Shard is 1,016ft high (310m) and has 87 storeys.

The woman were bailed to return to a police station on 15 August

They evaded security guards to begin their climb in the early morning, saying the protest was intended to put Shell and other oil companies in the spotlight and they live-streamed the stunt using head cameras.

As the protesters reached the summit, Greenpeace UK executive director John Sauven said: "It is an honour to stand here at the foot of Europe's highest building and witness this remarkable achievement by these women.

"Watching them fly the flag to protect the Arctic from the top of the Shard is a remarkable sight."

But in a statement Shell said oil and gas production in the Arctic "was not new".

The Qatari-owned building, which was opened in February, contains offices, restaurants, a hotel and residential apartments.

Deported Mubenga killed unlawfully

An Angolan man who died after being restrained by three security guards as he was deported from the UK was killed unlawfully, a jury has found.

Jimmy Mubenga, 46, became ill on the British Airways plane as it prepared to leave Heathrow Airport in 2010, and died shortly afterwards.

Catherine Kyie jailed over dead woman's identity theft

A mother-of-three from Ghana who stole a dead woman's identity so she could live in south Wales illegally with her family has been jailed.
Catherine Kyie was jailed for 15 months
at Cardiff Crown Court

Cardiff Crown Court heard Catherine Kyie, 33, defrauded taxpayers out of £100,000 in benefits over eight years.

She and Kenneth Boateng, 45, who posed as her husband, admitted 14 charges of fraud by misrepresentation to enter and stay in the UK illegally.

Both will be deported after serving jail terms of 15 months and 12 months.

The fraud was discovered after relatives of Joyce Pokuaa found her name had been used to renew a passport a few years after her death.

Kyie, who had settled in Newport, was given the longer term as the "prime mover" in the fraud.

The court was told she impersonated Ms Pokuaa - another Ghanaian woman who had married a Dutch man and started a family but who had died.

Ms Pokuaa's marriage had meant she had been free to travel through Europe.
Judge Patrick Murphy said Kyie began stealing the dead mother's identity documents in 2004, just months after she gave birth to a son and died in Ghana following childbirth complications.

He told Kyie and Boateng it was now their children who had become the innocent victims.

"You took the chance - they will pay the price," he said.

"You obtained benefits through employment and tax benefits to the cost of £104,562.

"Possession and use of false identity documents are serious offences and go to the heart of undermining the immigration processes of this country."

'Better life'

Kyie's documents allowed Boateng to pretend to be her husband so he could illegally gain entry into Britain in 2005, the court heard.

The couple and their three children lived in Britain illegally claiming state benefits and child tax credits.

They lived in Duffryn for eight years while she worked as a cleaner in NHS hospitals and universities, while Boateng worked as a driver and late night security guard.

But Cardiff Crown Court heard they were discovered when relatives of the dead mother's 10-year-old son wanted him to come to the country.

Prosecutor Roger Griffiths said: "He was unable to travel because it was discovered his passport had been renewed in 2009 by Boateng and a woman claiming to be his mother - although she had been dead for five or six years."

That passport was eventually found at Kyie and Boateng's home.

"Police also discovered a Dutch identity card and a passport in the name of Joyce Pokuaa but showing Kyie's photograph," added Mr Griffiths.

The court heard two of the couple's three children were born in the UK.

Claire Pickthall, defending Kyie, said: "It is a serious offence and she accepts her motivation was gain.

"But the gain was only to come to the UK to have a better life for herself and her family - nothing more sinister than that.
"She has worked hard all the time she has been here."

Supplying Illegal Security Guard Costs Company Over £30,000

A Peterborough based security company has been found guilty of illegally supplying a security guard to work on a construction site and ordered to pay more than £30,000.

On Thursday [16 May], at Norwich Crown Court, Scarlet Security Limited was fined £3,000 and order to pay full costs of £31,347.98.

In November 2011, after intelligence reports of illegal activity were received, Scarlet Security Limited, based in Stuart House, St John Street, Peterborough, was investigated by Security Industry Authority investigators, who were supported by Norfolk and Cambridgeshire Police and the UKBA.

As a result of the investigation an employee of the company was found to be working illegally, without an SIA licence. Further, the individual was arrested, referred to the UKBA and subsequently deported as he did not have the right to remain in the UK.

Scarlet Security Limited elected to have the case heard in Crown Court, where the court heard that the owner of the company was a Ken Washington and its former Director a Caroline Kariuki. However, at trial the company was not represented and no defence to the indictment was presented to the jury.

In sentencing the company, Recorder Rupert Lowe stated that he was satisfied that the deported individual "had worked for the company for some time," and acknowledged the importance of the case as the offence "undermines the regulatory framework and immigration system."

Head of Investigation Nathan Salmon said

"The prosecution of Scarlet Security is a reminder that some businesses continue to supply individuals to work in the private security industry unlicensed.
"The company was not undertaking adequate vetting of its staff as it claimed it had done. It is a concern for the regulator that the individual worked in the industry although he did not have the right to remain in the UK.

"We were unable to engage with persons in control of the business at the time of the offence which has frustrated proceedings; however, this verdict is very positive.

"Although the individuals running Scarlet Security have decided to liquidate the business, the SIA felt it important to progress this prosecution as taking such a course of action should not be a protection against prosecution. I am thankful to our partners in this investigation."
